Terms and Conditions
Last updated: September 3, 2026
1. Who we are
WPML Smart Translate is provided by E-Commerce Update ("we", "us", "our"). By purchasing or using WPML Smart Translate, you enter into a contract directly with E-Commerce Update.
2. Acceptance
By installing, accessing, or continuing to use WPML Smart Translate, you represent that you have read and accepted these Terms. If you are entering into this agreement on behalf of a company, you represent that you have the authority to bind it; if you are entering into it as an individual, you represent that you have reached the legal age of majority.
3. The product
WPML Smart Translate is a WordPress addon that works on top of WPML and translates pages on demand, at the moment a visitor accesses them, using Google Translate or AI engines (Anthropic, OpenAI, DeepSeek, OpenRouter, DeepInfra). When you use AI engines with your own API keys, the cost of using those APIs is billed directly by the provider you choose.
4. License
We grant you a limited, non-exclusive, non-transferable right to use WPML Smart Translate on one site for the duration of the annual license, in accordance with the plan you purchased. You may not resell, redistribute, sublicense, reverse engineer, or circumvent the product's technical or licensing restrictions.
5. Account and credentials
You are responsible for keeping your license key and access credentials confidential, as well as for all activity carried out using them. You must provide accurate information and keep it up to date.
6. Prohibited use
You must not use the service for:
- any unlawful purpose or one that infringes the rights of others;
- fraud, spam, or sending misleading content;
- infringing intellectual property rights;
- compromising the security of the service, including malware, vulnerability scanning, deliberate overload, or unauthorized scraping.
7. Content, translations, and responsibility for text
You are responsible for the content submitted for translation and represent that you hold the necessary rights to it. Translations are generated automatically and may contain inaccuracies: they do not replace human review and should not be used, without supervision, in regulated contexts (legal, medical, financial). You grant us a limited license to process your content solely to provide the service. Rights holders may request removal of content through our support channel; repeated violations may result in termination of access.
8. Intellectual property
WPML Smart Translate, its code, documentation, and brand remain the exclusive property of E-Commerce Update. No rights other than the license of use described above are granted.
9. Service level and warranties
We use reasonable efforts to keep the service available, but we do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.
10. Payment and subscription
The license costs US$59 per year, per site. Payment, billing, taxes, renewal, cancellation, and refunds are handled by Paddle, in accordance with the Paddle Buyer Terms. See also our Refund Policy.
11. Reseller and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
12. Suspension and termination
We may suspend or terminate access in the event of a material breach of these Terms, failure to pay, security or fraud risk, or repeated or serious violations of our policies. Once access is terminated, you may no longer use the addon; data associated with the account may be deleted after a reasonable export period.
13. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to the amounts you paid in the 12 months preceding the event. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or reputation. Nothing in these Terms excludes liability for fraud, willful misconduct, death, or personal injury where the law does not permit such exclusion.
14. Indemnification
You will indemnify us against claims arising from your content, unlawful use of the service, or breach of these Terms.
15. General provisions
These Terms are governed by the laws applicable to E-Commerce Update's jurisdiction, without prejudice to any mandatory consumer rights that may apply. You may not assign this agreement without our consent; we may assign it in the event of a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. We may update these Terms and will indicate the date of the last revision on this page.
